國務院辦公廳關于促進建筑業持續健康發展的意見

各省、自治區(qu)、直轄市人民(min)政(zheng)府(fu),國務院各部委、各直屬機(ji)構(gou):


建(jian)筑業(ye)(ye)是國民(min)經濟的支(zhi)柱產業(ye)(ye)。改(gai)革(ge)(ge)開放(fang)以來(lai),我國建(jian)筑業(ye)(ye)快速發展,建(jian)造能力不斷增強(qiang),產業(ye)(ye)規(gui)(gui)模(mo)不斷擴大,吸(xi)納了(le)大量(liang)農村(cun)轉移勞動(dong)力,帶動(dong)了(le)大量(liang)關(guan)聯產業(ye)(ye),對經濟社(she)會發展、城(cheng)鄉建(jian)設和(he)民(min)生改(gai)善作(zuo)出了(le)重要(yao)貢獻。但也要(yao)看(kan)到,建(jian)筑業(ye)(ye)仍然大而不強(qiang),監管體制機制不健(jian)全(quan)、工程建(jian)設組織方式落(luo)后、建(jian)筑設計水平有待提高、質量(liang)安全(quan)事(shi)故時有發生、市(shi)場違法違規(gui)(gui)行為(wei)(wei)(wei)(wei)較(jiao)多、企(qi)業(ye)(ye)核心(xin)競爭力不強(qiang)、工人技能素質偏低等問題較(jiao)為(wei)(wei)(wei)(wei)突出。為(wei)(wei)(wei)(wei)貫徹落(luo)實(shi)《中(zhong)共中(zhong)央 國務院關(guan)于進一步加強(qiang)城(cheng)市(shi)規(gui)(gui)劃建(jian)設管理工作(zuo)的若干(gan)意(yi)見》,進一步深化建(jian)筑業(ye)(ye)“放(fang)管服”改(gai)革(ge)(ge),加快產業(ye)(ye)升級(ji),促進建(jian)筑業(ye)(ye)持續(xu)健(jian)康(kang)發展,為(wei)(wei)(wei)(wei)新型城(cheng)鎮(zhen)化提供(gong)支(zhi)撐,經國務院同意(yi),現提出以下意(yi)見:


一(yi)、總(zong)體要(yao)求


全(quan)(quan)面貫徹(che)黨的(de)十八大(da)和(he)(he)十八屆二(er)中(zhong)、三(san)中(zhong)、四中(zhong)、五(wu)中(zhong)、六(liu)中(zhong)全(quan)(quan)會(hui)以及中(zhong)央經濟(ji)工作(zuo)會(hui)議(yi)、中(zhong)央城(cheng)鎮(zhen)化(hua)工作(zuo)會(hui)議(yi)、中(zhong)央城(cheng)市工作(zuo)會(hui)議(yi)精神(shen),深入貫徹(che)習近平總(zong)書(shu)記系列重要(yao)講話(hua)精神(shen)和(he)(he)治國理(li)政新理(li)念新思想新戰(zhan)略,認(ren)真落(luo)實黨中(zhong)央、國務院決策部署(shu),統(tong)籌(chou)推(tui)進(jin)“五(wu)位一體”總(zong)體布(bu)局(ju)和(he)(he)協(xie)調推(tui)進(jin)“四個全(quan)(quan)面”戰(zhan)略布(bu)局(ju),牢固樹立(li)和(he)(he)貫徹(che)落(luo)實創(chuang)新、協(xie)調、綠色、開放(fang)、共享的(de)發展(zhan)理(li)念,堅持以推(tui)進(jin)供給(gei)側(ce)結構性(xing)改革為主(zhu)線,按(an)照適用(yong)、經濟(ji)、安(an)全(quan)(quan)、綠色、美觀的(de)要(yao)求(qiu),深化(hua)建(jian)筑業(ye)“放(fang)管服”改革,完(wan)善監管體制機制,優化(hua)市場環境,提升工程(cheng)質量安(an)全(quan)(quan)水(shui)平,強(qiang)化(hua)隊伍建(jian)設,增強(qiang)企業(ye)核心競爭力(li),促進(jin)建(jian)筑業(ye)持續(xu)健康發展(zhan),打造(zao)“中(zhong)國建(jian)造(zao)”品牌。


二(er)、深化(hua)建筑業簡政放權改(gai)革


(一(yi))優化資(zi)(zi)(zi)質(zhi)(zhi)資(zi)(zi)(zi)格(ge)管(guan)理(li)。進一(yi)步簡化工程建設企(qi)業(ye)資(zi)(zi)(zi)質(zhi)(zhi)類別(bie)和等(deng)級設置,減少不必要的(de)資(zi)(zi)(zi)質(zhi)(zhi)認(ren)定。選擇部分地區開展(zhan)試點,對信用良好、具有相關專(zhuan)業(ye)技術能力(li)、能夠提(ti)供(gong)足額擔保(bao)的(de)企(qi)業(ye),在(zai)其資(zi)(zi)(zi)質(zhi)(zhi)類別(bie)內(nei)放寬(kuan)承攬業(ye)務(wu)(wu)范圍限制,同時,加(jia)快完善信用體(ti)系、工程擔保(bao)及個(ge)(ge)(ge)人(ren)執(zhi)業(ye)資(zi)(zi)(zi)格(ge)等(deng)相關配(pei)套制度(du),加(jia)強(qiang)事(shi)中(zhong)事(shi)后(hou)監管(guan)。強(qiang)化個(ge)(ge)(ge)人(ren)執(zhi)業(ye)資(zi)(zi)(zi)格(ge)管(guan)理(li),明(ming)晰注冊執(zhi)業(ye)人(ren)員的(de)權利、義(yi)務(wu)(wu)和責(ze)任,加(jia)大執(zhi)業(ye)責(ze)任追(zhui)究力(li)度(du)。有序發展(zhan)個(ge)(ge)(ge)人(ren)執(zhi)業(ye)事(shi)務(wu)(wu)所,推動建立個(ge)(ge)(ge)人(ren)執(zhi)業(ye)保(bao)險制度(du)。大力(li)推行“互聯網+政(zheng)務(wu)(wu)服務(wu)(wu)”,實行“一(yi)站(zhan)式”網上審批,進一(yi)步提(ti)高建筑領域行政(zheng)審批效率。


(二)完(wan)善招標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)制度。加快修(xiu)訂《工(gong)程(cheng)(cheng)建設(she)項(xiang)目(mu)(mu)招標(biao)(biao)(biao)(biao)范圍(wei)和規模標(biao)(biao)(biao)(biao)準規定(ding)》,縮(suo)小并嚴格界定(ding)必須進行招標(biao)(biao)(biao)(biao)的工(gong)程(cheng)(cheng)建設(she)項(xiang)目(mu)(mu)范圍(wei),放寬有關規模標(biao)(biao)(biao)(biao)準,防止工(gong)程(cheng)(cheng)建設(she)項(xiang)目(mu)(mu)實行招標(biao)(biao)(biao)(biao)“一(yi)刀切”。在民間投(tou)資的房屋(wu)建筑工(gong)程(cheng)(cheng)中,探索由建設(she)單(dan)位(wei)自主(zhu)決定(ding)發包方(fang)式。將依法(fa)必須招標(biao)(biao)(biao)(biao)的工(gong)程(cheng)(cheng)建設(she)項(xiang)目(mu)(mu)納入統一(yi)的公共資源(yuan)交易(yi)平(ping)臺,遵循公平(ping)、公正(zheng)、公開(kai)和誠(cheng)信(xin)的原(yuan)則,規范招標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)行為。進一(yi)步簡化招標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)程(cheng)(cheng)序,盡快實現招標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)交易(yi)全過(guo)程(cheng)(cheng)電子化,推行網上(shang)異(yi)地評標(biao)(biao)(biao)(biao)。對依法(fa)通過(guo)競爭性談判或單(dan)一(yi)來源(yuan)方(fang)式確定(ding)供應(ying)(ying)商(shang)的政府采購工(gong)程(cheng)(cheng)建設(she)項(xiang)目(mu)(mu),符(fu)合相應(ying)(ying)條件的應(ying)(ying)當頒發施工(gong)許可證。


三(san)、完善工(gong)程建設組織模式(shi)


(三)加(jia)快(kuai)推行工(gong)(gong)程(cheng)(cheng)(cheng)總(zong)(zong)承(cheng)包(bao)。裝(zhuang)配式(shi)建筑(zhu)原(yuan)則(ze)上應(ying)采用工(gong)(gong)程(cheng)(cheng)(cheng)總(zong)(zong)承(cheng)包(bao)模式(shi)。政府投資工(gong)(gong)程(cheng)(cheng)(cheng)應(ying)完善(shan)建設(she)管理模式(shi),帶頭推行工(gong)(gong)程(cheng)(cheng)(cheng)總(zong)(zong)承(cheng)包(bao)。加(jia)快(kuai)完善(shan)工(gong)(gong)程(cheng)(cheng)(cheng)總(zong)(zong)承(cheng)包(bao)相(xiang)關的招標(biao)(biao)投標(biao)(biao)、施工(gong)(gong)許可(ke)(ke)、竣工(gong)(gong)驗收等制度規定。按照總(zong)(zong)承(cheng)包(bao)負(fu)總(zong)(zong)責(ze)的原(yuan)則(ze),落實工(gong)(gong)程(cheng)(cheng)(cheng)總(zong)(zong)承(cheng)包(bao)單位(wei)在(zai)工(gong)(gong)程(cheng)(cheng)(cheng)質量安全、進度控制、成本(ben)管理等方面的責(ze)任。除以(yi)暫估價(jia)形(xing)式(shi)包(bao)括(kuo)在(zai)工(gong)(gong)程(cheng)(cheng)(cheng)總(zong)(zong)承(cheng)包(bao)范圍內且(qie)依法必(bi)須進行招標(biao)(biao)的項目(mu)外,工(gong)(gong)程(cheng)(cheng)(cheng)總(zong)(zong)承(cheng)包(bao)單位(wei)可(ke)(ke)以(yi)直接發(fa)包(bao)總(zong)(zong)承(cheng)包(bao)合(he)同中涵(han)蓋的其(qi)他專業業務。


(四)培(pei)育全(quan)(quan)(quan)(quan)(quan)過(guo)程(cheng)(cheng)工程(cheng)(cheng)咨(zi)(zi)詢。鼓(gu)(gu)勵投資(zi)咨(zi)(zi)詢、勘察、設計(ji)、監理、招標(biao)(biao)代理、造價等企業采取聯合經營、并(bing)購重組(zu)等方式(shi)發展全(quan)(quan)(quan)(quan)(quan)過(guo)程(cheng)(cheng)工程(cheng)(cheng)咨(zi)(zi)詢,培(pei)育一批具有(you)國際(ji)水平的(de)全(quan)(quan)(quan)(quan)(quan)過(guo)程(cheng)(cheng)工程(cheng)(cheng)咨(zi)(zi)詢企業。制定(ding)全(quan)(quan)(quan)(quan)(quan)過(guo)程(cheng)(cheng)工程(cheng)(cheng)咨(zi)(zi)詢服務技(ji)術標(biao)(biao)準(zhun)和合同范本(ben)。政府(fu)投資(zi)工程(cheng)(cheng)應帶頭推行全(quan)(quan)(quan)(quan)(quan)過(guo)程(cheng)(cheng)工程(cheng)(cheng)咨(zi)(zi)詢,鼓(gu)(gu)勵非(fei)政府(fu)投資(zi)工程(cheng)(cheng)委(wei)托全(quan)(quan)(quan)(quan)(quan)過(guo)程(cheng)(cheng)工程(cheng)(cheng)咨(zi)(zi)詢服務。在民用建(jian)筑項目中(zhong),充分(fen)發揮建(jian)筑師的(de)主導作用,鼓(gu)(gu)勵提供(gong)全(quan)(quan)(quan)(quan)(quan)過(guo)程(cheng)(cheng)工程(cheng)(cheng)咨(zi)(zi)詢服務。


四、加強工程(cheng)質量安全管理(li)


(五)嚴格(ge)(ge)落實(shi)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)責(ze)(ze)任(ren)(ren)。全面落實(shi)各方(fang)主體的(de)(de)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)責(ze)(ze)任(ren)(ren),特別要強(qiang)化建(jian)設單位的(de)(de)首要責(ze)(ze)任(ren)(ren)和勘(kan)察、設計、施工(gong)(gong)單位的(de)(de)主體責(ze)(ze)任(ren)(ren)。嚴格(ge)(ge)執行(xing)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)終身(shen)責(ze)(ze)任(ren)(ren)制,在(zai)建(jian)筑物(wu)明顯部位設置永久性(xing)標牌,公(gong)示質(zhi)(zhi)量(liang)責(ze)(ze)任(ren)(ren)主體和主要責(ze)(ze)任(ren)(ren)人。對(dui)違反有(you)關(guan)規定、造成工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)事(shi)故的(de)(de),依(yi)法給予責(ze)(ze)任(ren)(ren)單位停(ting)業(ye)整(zheng)頓、降低資(zi)質(zhi)(zhi)等(deng)級、吊(diao)銷(xiao)資(zi)質(zhi)(zhi)證書(shu)等(deng)行(xing)政處罰并通過國家企(qi)業(ye)信用信息公(gong)示系統予以公(gong)示,給予注冊執業(ye)人員暫停(ting)執業(ye)、吊(diao)銷(xiao)資(zi)格(ge)(ge)證書(shu)、一(yi)定時(shi)間(jian)直至(zhi)終身(shen)不得進入行(xing)業(ye)等(deng)處罰。對(dui)發生(sheng)工(gong)(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)事(shi)故造成損失(shi)的(de)(de),要依(yi)法追究經(jing)濟賠償(chang)責(ze)(ze)任(ren)(ren),情節嚴重的(de)(de)要追究有(you)關(guan)單位和人員的(de)(de)法律(lv)責(ze)(ze)任(ren)(ren)。參與房地產開發的(de)(de)建(jian)筑業(ye)企(qi)業(ye)應依(yi)法合規經(jing)營,提(ti)高住宅品質(zhi)(zhi)。


(六)加(jia)強(qiang)安(an)(an)全(quan)生產(chan)管理(li)(li)。全(quan)面(mian)落實安(an)(an)全(quan)生產(chan)責任,加(jia)強(qiang)施工(gong)現(xian)場(chang)安(an)(an)全(quan)防護,特(te)別要強(qiang)化(hua)對深(shen)基(ji)坑(keng)、高支模、起(qi)重機械等危險(xian)(xian)性(xing)較大的(de)(de)分(fen)部(bu)分(fen)項工(gong)程(cheng)的(de)(de)管理(li)(li),以(yi)及(ji)(ji)對不良地(di)質地(di)區重大工(gong)程(cheng)項目的(de)(de)風險(xian)(xian)評估或論(lun)證。推(tui)進(jin)信(xin)(xin)息(xi)技術與(yu)安(an)(an)全(quan)生產(chan)深(shen)度融(rong)合(he),加(jia)快建(jian)設(she)建(jian)筑施工(gong)安(an)(an)全(quan)監管信(xin)(xin)息(xi)系統,通過(guo)信(xin)(xin)息(xi)化(hua)手段加(jia)強(qiang)安(an)(an)全(quan)生產(chan)管理(li)(li)。建(jian)立(li)健(jian)全(quan)全(quan)覆蓋、多層(ceng)次(ci)、經(jing)常性(xing)的(de)(de)安(an)(an)全(quan)生產(chan)培訓制度,提升從業人員安(an)(an)全(quan)素質以(yi)及(ji)(ji)各方主體(ti)的(de)(de)本質安(an)(an)全(quan)水平。


(七(qi))全面(mian)提高監(jian)(jian)管(guan)(guan)水平。完善工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)安全法(fa)律(lv)法(fa)規(gui)和管(guan)(guan)理(li)制(zhi)度(du)(du),健(jian)全企業負責、政府(fu)監(jian)(jian)管(guan)(guan)、社會監(jian)(jian)督(du)的(de)(de)工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)安全保障(zhang)體系。強(qiang)(qiang)(qiang)化政府(fu)對(dui)(dui)工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)的(de)(de)監(jian)(jian)管(guan)(guan),明(ming)確監(jian)(jian)管(guan)(guan)范圍(wei),落實(shi)監(jian)(jian)管(guan)(guan)責任,加(jia)大抽(chou)查(cha)抽(chou)測力度(du)(du),重點(dian)(dian)加(jia)強(qiang)(qiang)(qiang)對(dui)(dui)涉(she)及公共安全的(de)(de)工(gong)(gong)程(cheng)(cheng)(cheng)地基基礎、主體結構(gou)(gou)等(deng)部位(wei)和竣工(gong)(gong)驗收等(deng)環節(jie)的(de)(de)監(jian)(jian)督(du)檢(jian)(jian)(jian)查(cha)。加(jia)強(qiang)(qiang)(qiang)工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)監(jian)(jian)督(du)隊伍建設,監(jian)(jian)督(du)機構(gou)(gou)履行職能所需(xu)經(jing)費(fei)由(you)同級財政預算全額保障(zhang)。政府(fu)可采取購買服務的(de)(de)方式,委托具備條件的(de)(de)社會力量(liang)(liang)進(jin)行工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)監(jian)(jian)督(du)檢(jian)(jian)(jian)查(cha)。推(tui)進(jin)工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)安全標準化管(guan)(guan)理(li),督(du)促各方主體健(jian)全質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)安全管(guan)(guan)控機制(zhi)。強(qiang)(qiang)(qiang)化對(dui)(dui)工(gong)(gong)程(cheng)(cheng)(cheng)監(jian)(jian)理(li)的(de)(de)監(jian)(jian)管(guan)(guan),選擇部分(fen)地區開展監(jian)(jian)理(li)單(dan)位(wei)向政府(fu)報告(gao)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)監(jian)(jian)理(li)情況(kuang)的(de)(de)試點(dian)(dian)。加(jia)強(qiang)(qiang)(qiang)工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)檢(jian)(jian)(jian)測機構(gou)(gou)管(guan)(guan)理(li),嚴(yan)厲打擊出(chu)具虛假報告(gao)等(deng)行為。推(tui)動(dong)發展工(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)(zhi)(zhi)量(liang)(liang)保險。


五、優化建筑市場環境


(八)建(jian)立(li)統一開放市場(chang)。打破區域市場(chang)準入(ru)壁壘,取消各地區、各行(xing)業在法(fa)律(lv)、行(xing)政(zheng)法(fa)規(gui)和(he)國(guo)務(wu)院規(gui)定外(wai)對建(jian)筑(zhu)(zhu)業企(qi)業設(she)置(zhi)的(de)不合(he)理準入(ru)條(tiao)件;嚴(yan)禁擅自設(she)立(li)或變(bian)相設(she)立(li)審批、備案事項,為(wei)建(jian)筑(zhu)(zhu)業企(qi)業提供公(gong)平(ping)(ping)市場(chang)環境。完善全(quan)國(guo)建(jian)筑(zhu)(zhu)市場(chang)監(jian)管公(gong)共(gong)服務(wu)平(ping)(ping)臺,加快實現與全(quan)國(guo)信(xin)用信(xin)息共(gong)享平(ping)(ping)臺和(he)國(guo)家(jia)企(qi)業信(xin)用信(xin)息公(gong)示(shi)系(xi)統的(de)數據共(gong)享交換。建(jian)立(li)建(jian)筑(zhu)(zhu)市場(chang)主(zhu)體黑名單制度(du),依法(fa)依規(gui)全(quan)面(mian)公(gong)開企(qi)業和(he)個人信(xin)用記錄(lu),接(jie)受社會監(jian)督。


(九(jiu))加強承包履(lv)(lv)約管理。引導承包企業以銀(yin)行保(bao)(bao)函(han)或擔(dan)保(bao)(bao)公司保(bao)(bao)函(han)的形(xing)式,向建設單位提供履(lv)(lv)約擔(dan)保(bao)(bao)。對采用常規通用技(ji)術(shu)標準(zhun)的政府投(tou)資工程(cheng),在原則(ze)上實行最低價(jia)中(zhong)標的同時,有效發(fa)揮履(lv)(lv)約擔(dan)保(bao)(bao)的作用,防止惡意低價(jia)中(zhong)標,確保(bao)(bao)工程(cheng)投(tou)資不超預算。嚴(yan)厲查處轉包和違法分包等行為(wei)。完(wan)善工程(cheng)量清(qing)單計價(jia)體系和工程(cheng)造價(jia)信息發(fa)布機制(zhi),形(xing)成統一(yi)的工程(cheng)造價(jia)計價(jia)規則(ze),合理確定(ding)和有效控(kong)制(zhi)工程(cheng)造價(jia)。


(十(shi))規范(fan)工(gong)程(cheng)價款結算。審(shen)(shen)計(ji)(ji)機關應依法(fa)加強對以政府投(tou)資為(wei)主的(de)公共工(gong)程(cheng)建設(she)(she)項目的(de)審(shen)(shen)計(ji)(ji)監督,建設(she)(she)單位(wei)(wei)不(bu)(bu)得將未完(wan)成(cheng)審(shen)(shen)計(ji)(ji)作(zuo)為(wei)延期工(gong)程(cheng)結算、拖欠(qian)工(gong)程(cheng)款的(de)理(li)由。未完(wan)成(cheng)竣工(gong)結算的(de)項目,有關部(bu)門(men)不(bu)(bu)予辦理(li)產權登記(ji)。對長期拖欠(qian)工(gong)程(cheng)款的(de)單位(wei)(wei)不(bu)(bu)得批(pi)準新項目開工(gong)。嚴格執行工(gong)程(cheng)預(yu)(yu)(yu)付款制度,及時(shi)按(an)合同約(yue)定足額向承包單位(wei)(wei)支(zhi)付預(yu)(yu)(yu)付款。通過工(gong)程(cheng)款支(zhi)付擔保等經濟、法(fa)律手段約(yue)束建設(she)(she)單位(wei)(wei)履約(yue)行為(wei),預(yu)(yu)(yu)防(fang)拖欠(qian)工(gong)程(cheng)款。


六、提(ti)高從業人員素質


(十一)加(jia)快培(pei)養建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)人(ren)(ren)(ren)才(cai)。積極培(pei)育(yu)既(ji)有(you)國際視野又有(you)民族自信的(de)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)師(shi)隊伍。加(jia)快培(pei)養熟悉國際規則的(de)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)高級(ji)管理(li)人(ren)(ren)(ren)才(cai)。大力(li)推進校企(qi)合作,培(pei)養建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)專業(ye)(ye)(ye)人(ren)(ren)(ren)才(cai)。加(jia)強工(gong)(gong)(gong)(gong)程現(xian)(xian)場管理(li)人(ren)(ren)(ren)員和建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)的(de)教育(yu)培(pei)訓。健全建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)職(zhi)業(ye)(ye)(ye)技(ji)(ji)(ji)能標(biao)準(zhun)體系,全面實施建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)技(ji)(ji)(ji)術工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)職(zhi)業(ye)(ye)(ye)技(ji)(ji)(ji)能鑒定制度。發展一批(pi)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)技(ji)(ji)(ji)能鑒定機構,開展建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)技(ji)(ji)(ji)能評價(jia)工(gong)(gong)(gong)(gong)作。通過制定施工(gong)(gong)(gong)(gong)現(xian)(xian)場技(ji)(ji)(ji)能工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)基本(ben)配(pei)備標(biao)準(zhun)、發布各個技(ji)(ji)(ji)能等級(ji)和工(gong)(gong)(gong)(gong)種的(de)人(ren)(ren)(ren)工(gong)(gong)(gong)(gong)成(cheng)本(ben)信息等方式,引導企(qi)業(ye)(ye)(ye)將工(gong)(gong)(gong)(gong)資分配(pei)向關鍵技(ji)(ji)(ji)術技(ji)(ji)(ji)能崗位傾(qing)斜。大力(li)弘揚工(gong)(gong)(gong)(gong)匠(jiang)精神,培(pei)養高素質建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren),到2020年建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)中級(ji)工(gong)(gong)(gong)(gong)技(ji)(ji)(ji)能水平以上的(de)建(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)數量(liang)達(da)到300萬,2025年達(da)到1000萬。


(十二)改革建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)用工制(zhi)度(du)。推(tui)動建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)(ye)勞務企(qi)業(ye)(ye)(ye)(ye)(ye)轉型,大力發展木(mu)工、電工、砌筑(zhu)(zhu)(zhu)(zhu)、鋼(gang)筋(jin)制(zhi)作等(deng)以作業(ye)(ye)(ye)(ye)(ye)為(wei)(wei)主(zhu)的(de)專業(ye)(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)(ye)。以專業(ye)(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)(ye)為(wei)(wei)建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工人(ren)的(de)主(zhu)要載體(ti),逐步(bu)實現(xian)建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工人(ren)公司化(hua)、專業(ye)(ye)(ye)(ye)(ye)化(hua)管(guan)理。鼓勵(li)現(xian)有專業(ye)(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)(ye)進一(yi)步(bu)做專做精,增強競爭力,推(tui)動形成一(yi)批以作業(ye)(ye)(ye)(ye)(ye)為(wei)(wei)主(zhu)的(de)建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)(ye)專業(ye)(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)(ye)。促進建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)(ye)農民(min)工向技術(shu)工人(ren)轉型,著力穩定(ding)和擴大建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)業(ye)(ye)(ye)(ye)(ye)農民(min)工就業(ye)(ye)(ye)(ye)(ye)創業(ye)(ye)(ye)(ye)(ye)。建(jian)(jian)(jian)(jian)立(li)全國(guo)建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工人(ren)管(guan)理服務信(xin)息平(ping)臺(tai),開(kai)展建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工人(ren)實名制(zhi)管(guan)理,記錄建(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)(zhu)工人(ren)的(de)身份信(xin)息、培(pei)訓情況、職業(ye)(ye)(ye)(ye)(ye)技能、從業(ye)(ye)(ye)(ye)(ye)記錄等(deng)信(xin)息,逐步(bu)實現(xian)全覆蓋。


(十(shi)三)保(bao)護工(gong)(gong)(gong)人(ren)合法(fa)權益(yi)。全(quan)面落實勞(lao)動合同(tong)制度(du),加大(da)(da)監察力度(du),督促施(shi)工(gong)(gong)(gong)單(dan)(dan)位與招(zhao)用(yong)的(de)(de)建(jian)(jian)(jian)筑(zhu)工(gong)(gong)(gong)人(ren)依(yi)法(fa)簽訂(ding)勞(lao)動合同(tong),到2020年基本(ben)實現勞(lao)動合同(tong)全(quan)覆蓋(gai)。健全(quan)工(gong)(gong)(gong)資支付(fu)保(bao)障(zhang)制度(du),按(an)照誰(shui)(shui)用(yong)工(gong)(gong)(gong)誰(shui)(shui)負責和總承(cheng)包負總責的(de)(de)原則(ze),落實企(qi)(qi)業(ye)(ye)工(gong)(gong)(gong)資支付(fu)責任,依(yi)法(fa)按(an)月足額發放工(gong)(gong)(gong)人(ren)工(gong)(gong)(gong)資。將存(cun)在(zai)拖(tuo)欠工(gong)(gong)(gong)資行(xing)為(wei)的(de)(de)企(qi)(qi)業(ye)(ye)列入黑名單(dan)(dan),對其采取限制市場準(zhun)入等懲戒措(cuo)施(shi),情節(jie)嚴重(zhong)的(de)(de)降(jiang)低資質等級(ji)。建(jian)(jian)(jian)立健全(quan)與建(jian)(jian)(jian)筑(zhu)業(ye)(ye)相適應的(de)(de)社會保(bao)險(xian)參(can)保(bao)繳費(fei)方(fang)式,大(da)(da)力推進建(jian)(jian)(jian)筑(zhu)施(shi)工(gong)(gong)(gong)單(dan)(dan)位參(can)加工(gong)(gong)(gong)傷保(bao)險(xian)。施(shi)工(gong)(gong)(gong)單(dan)(dan)位應履行(xing)社會責任,不斷改善建(jian)(jian)(jian)筑(zhu)工(gong)(gong)(gong)人(ren)的(de)(de)工(gong)(gong)(gong)作環境,提升職(zhi)業(ye)(ye)健康水平,促進建(jian)(jian)(jian)筑(zhu)工(gong)(gong)(gong)人(ren)穩定就業(ye)(ye)。


七、推(tui)進建筑(zhu)產業現(xian)代化


(十四(si))推廣(guang)智能(neng)(neng)和裝(zhuang)(zhuang)(zhuang)配式建(jian)(jian)筑。堅(jian)持標準化(hua)(hua)(hua)(hua)設計、工廠(chang)化(hua)(hua)(hua)(hua)生產、裝(zhuang)(zhuang)(zhuang)配化(hua)(hua)(hua)(hua)施(shi)工、一體化(hua)(hua)(hua)(hua)裝(zhuang)(zhuang)(zhuang)修(xiu)、信息化(hua)(hua)(hua)(hua)管(guan)理、智能(neng)(neng)化(hua)(hua)(hua)(hua)應用,推動建(jian)(jian)造方(fang)式創新(xin),大(da)力發(fa)展裝(zhuang)(zhuang)(zhuang)配式混凝土和鋼結構建(jian)(jian)筑,在具備(bei)條件的地方(fang)倡(chang)導發(fa)展現代木(mu)結構建(jian)(jian)筑,不斷提高裝(zhuang)(zhuang)(zhuang)配式建(jian)(jian)筑在新(xin)建(jian)(jian)建(jian)(jian)筑中(zhong)的比例。力爭用10年(nian)左右的時(shi)間,使(shi)裝(zhuang)(zhuang)(zhuang)配式建(jian)(jian)筑占新(xin)建(jian)(jian)建(jian)(jian)筑面(mian)積的比例達到(dao)30%。在新(xin)建(jian)(jian)建(jian)(jian)筑和既有建(jian)(jian)筑改造中(zhong)推廣(guang)普及智能(neng)(neng)化(hua)(hua)(hua)(hua)應用,完善(shan)智能(neng)(neng)化(hua)(hua)(hua)(hua)系統運(yun)行維護機制,實現建(jian)(jian)筑舒(shu)適安全、節能(neng)(neng)高效。


(十(shi)五(wu))提升(sheng)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)設(she)計(ji)水平。建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)設(she)計(ji)應(ying)體現(xian)地域特(te)征(zheng)、民族特(te)點和時代風貌,突出建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)使用功能及(ji)節(jie)能、節(jie)水、節(jie)地、節(jie)材和環保等要求,提供功能適用、經濟(ji)合(he)理、安全(quan)可靠、技術先進(jin)(jin)、環境協(xie)調的建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)設(she)計(ji)產品。健(jian)全(quan)適應(ying)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)設(she)計(ji)特(te)點的招(zhao)(zhao)標(biao)投標(biao)制度,推行設(she)計(ji)團隊招(zhao)(zhao)標(biao)、設(she)計(ji)方案(an)招(zhao)(zhao)標(biao)等方式。促進(jin)(jin)國內外建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)設(she)計(ji)企(qi)業(ye)公平競(jing)爭,培育有國際(ji)競(jing)爭力(li)的建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)設(she)計(ji)隊伍。倡導(dao)開展建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)評論,促進(jin)(jin)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)設(she)計(ji)理念的融合(he)和升(sheng)華。


(十六)加強技(ji)術(shu)(shu)研發(fa)應用。加快先進(jin)建(jian)造(zao)設(she)(she)備(bei)(bei)、智能設(she)(she)備(bei)(bei)的(de)研發(fa)、制造(zao)和(he)(he)推(tui)廣應用,提(ti)(ti)升各類(lei)施工(gong)(gong)(gong)機(ji)具(ju)的(de)性能和(he)(he)效(xiao)率,提(ti)(ti)高機(ji)械化(hua)(hua)施工(gong)(gong)(gong)程度。限制和(he)(he)淘汰落(luo)后、危險工(gong)(gong)(gong)藝工(gong)(gong)(gong)法,保障(zhang)生(sheng)產施工(gong)(gong)(gong)安全。積極支(zhi)持(chi)建(jian)筑業(ye)科(ke)研工(gong)(gong)(gong)作(zuo),大(da)幅提(ti)(ti)高技(ji)術(shu)(shu)創新(xin)對產業(ye)發(fa)展的(de)貢(gong)獻率。加快推(tui)進(jin)建(jian)筑信(xin)息模型(xing)(BIM)技(ji)術(shu)(shu)在規劃(hua)、勘(kan)察(cha)、設(she)(she)計、施工(gong)(gong)(gong)和(he)(he)運營維護全過(guo)程的(de)集成應用,實現(xian)工(gong)(gong)(gong)程建(jian)設(she)(she)項(xiang)目全生(sheng)命周期數據共享和(he)(he)信(xin)息化(hua)(hua)管理,為項(xiang)目方案優化(hua)(hua)和(he)(he)科(ke)學決策提(ti)(ti)供依據,促進(jin)建(jian)筑業(ye)提(ti)(ti)質增效(xiao)。


(十七(qi))完善(shan)工程(cheng)建設標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)。整合精簡強(qiang)制(zhi)性標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun),適度提高(gao)(gao)安(an)全(quan)、質量、性能、健康(kang)、節能等強(qiang)制(zhi)性指標(biao)(biao)(biao)要求(qiu),逐步提高(gao)(gao)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)水(shui)平(ping)。積(ji)極培育(yu)團體(ti)(ti)(ti)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun),鼓勵(li)具備相應(ying)能力的(de)(de)行業(ye)協(xie)會、產業(ye)聯盟等主(zhu)體(ti)(ti)(ti)共同制(zhi)定(ding)滿(man)足市場和(he)創新需(xu)要的(de)(de)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun),建立強(qiang)制(zhi)性標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)與(yu)團體(ti)(ti)(ti)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)相結合的(de)(de)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)供給體(ti)(ti)(ti)制(zhi),增加標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)有效供給。及時開(kai)展(zhan)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)復審,加快標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)修訂(ding),提高(gao)(gao)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)的(de)(de)時效性。加強(qiang)科(ke)技(ji)研發(fa)與(yu)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)制(zhi)定(ding)的(de)(de)信息溝通,建立全(quan)國工程(cheng)建設標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)專家委員會,為(wei)工程(cheng)建設標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)化工作提供技(ji)術支(zhi)撐,提高(gao)(gao)標(biao)(biao)(biao)準(zhun)(zhun)(zhun)(zhun)的(de)(de)質量和(he)水(shui)平(ping)。


八、加快(kuai)建筑業企業“走出去(qu)”


(十八)加(jia)強中(zhong)(zhong)外(wai)標(biao)準銜接。積極開展中(zhong)(zhong)外(wai)標(biao)準對比研究,適應(ying)國(guo)際通行(xing)的(de)標(biao)準內容(rong)結構、要素指標(biao)和(he)(he)相關術(shu)(shu)語,縮小中(zhong)(zhong)國(guo)標(biao)準與國(guo)外(wai)先進標(biao)準的(de)技(ji)術(shu)(shu)差距。加(jia)大(da)中(zhong)(zhong)國(guo)標(biao)準外(wai)文版翻譯和(he)(he)宣傳推廣力度,以(yi)“一(yi)帶一(yi)路”戰略為(wei)引領,優先在對外(wai)投資、技(ji)術(shu)(shu)輸出和(he)(he)援建工(gong)程項目中(zhong)(zhong)推廣應(ying)用(yong)。積極參加(jia)國(guo)際標(biao)準認證、交(jiao)流等活動,開展工(gong)程技(ji)術(shu)(shu)標(biao)準的(de)雙邊合作。到2025年,實(shi)現工(gong)程建設國(guo)家標(biao)準全部有外(wai)文版。


(十九)提高(gao)對(dui)(dui)外承(cheng)包(bao)能(neng)力。統籌協調建(jian)筑業(ye)(ye)“走出去”,充分發揮(hui)我(wo)國建(jian)筑業(ye)(ye)企(qi)業(ye)(ye)在高(gao)鐵、公路(lu)、電力、港(gang)口、機場、油氣長輸(shu)管(guan)(guan)道、高(gao)層建(jian)筑等工(gong)程建(jian)設(she)方(fang)面的(de)比較優勢,有(you)目(mu)標、有(you)重點(dian)、有(you)組織地(di)(di)(di)對(dui)(dui)外承(cheng)包(bao)工(gong)程,參(can)與“一(yi)帶一(yi)路(lu)”建(jian)設(she)。建(jian)筑業(ye)(ye)企(qi)業(ye)(ye)要加(jia)(jia)大對(dui)(dui)國際(ji)標準的(de)研究力度(du),積(ji)(ji)極適應國際(ji)標準,加(jia)(jia)強對(dui)(dui)外承(cheng)包(bao)工(gong)程質量、履(lv)約等方(fang)面管(guan)(guan)理(li),在援外住房等民(min)生項(xiang)目(mu)中(zhong)發揮(hui)積(ji)(ji)極作用。鼓勵大企(qi)業(ye)(ye)帶動(dong)中(zhong)小(xiao)企(qi)業(ye)(ye)、沿海沿邊地(di)(di)(di)區(qu)企(qi)業(ye)(ye)合作“出海”,積(ji)(ji)極有(you)序開拓國際(ji)市場,避免惡性競爭。引導對(dui)(dui)外承(cheng)包(bao)工(gong)程企(qi)業(ye)(ye)向項(xiang)目(mu)融(rong)資、設(she)計(ji)咨詢、后續運營維(wei)護管(guan)(guan)理(li)等高(gao)附加(jia)(jia)值(zhi)的(de)領(ling)域有(you)序拓展。推動(dong)企(qi)業(ye)(ye)提高(gao)屬地(di)(di)(di)化經營水平,實現與所在國家和地(di)(di)(di)區(qu)互利共贏(ying)。


(二十)加大(da)政策扶持(chi)(chi)力(li)度。加強建(jian)筑(zhu)業(ye)(ye)“走出去(qu)”相關(guan)主管部門間的溝(gou)通(tong)(tong)協調和信息共享。到2025年,與大(da)部分“一帶(dai)一路”沿(yan)線國家和地(di)區簽訂雙(shuang)邊工程建(jian)設合(he)作備忘錄,同時爭取在雙(shuang)邊自貿(mao)協定中(zhong)納入相關(guan)內(nei)容,推進建(jian)設領域(yu)執業(ye)(ye)資格國際互(hu)認。綜合(he)發揮各類金融(rong)工具的作用,重點(dian)支(zhi)(zhi)持(chi)(chi)對(dui)外經濟合(he)作中(zhong)建(jian)筑(zhu)領域(yu)的重大(da)戰略項目。借鑒國際通(tong)(tong)行(xing)的項目融(rong)資模式,按照風險(xian)可(ke)控、商業(ye)(ye)可(ke)持(chi)(chi)續原(yuan)則,加大(da)對(dui)建(jian)筑(zhu)業(ye)(ye)“走出去(qu)”的金融(rong)支(zhi)(zhi)持(chi)(chi)力(li)度。


各(ge)地區(qu)、各(ge)部門要(yao)高度重(zhong)視深化(hua)建筑業(ye)改(gai)革工(gong)作(zuo),健全工(gong)作(zuo)機制,明確任(ren)務(wu)分工(gong),及時(shi)研究解決建筑業(ye)改(gai)革發(fa)展(zhan)中的(de)重(zhong)大問題,完(wan)善(shan)相(xiang)關(guan)(guan)政策,確保(bao)按期(qi)完(wan)成各(ge)項(xiang)改(gai)革任(ren)務(wu)。加快推動修訂建筑法(fa)(fa)、招標投標法(fa)(fa)等法(fa)(fa)律(lv)(lv),完(wan)善(shan)相(xiang)關(guan)(guan)法(fa)(fa)律(lv)(lv)法(fa)(fa)規。充分發(fa)揮協會商會熟悉行(xing)(xing)業(ye)、貼近(jin)企(qi)業(ye)的(de)優(you)勢,及時(shi)反(fan)映企(qi)業(ye)訴(su)求,反(fan)饋政策落實(shi)情況(kuang),發(fa)揮好規范(fan)行(xing)(xing)業(ye)秩(zhi)序、建立從業(ye)人員行(xing)(xing)為準則(ze)、促進(jin)企(qi)業(ye)誠信經營等方面的(de)自(zi)律(lv)(lv)作(zuo)用(yong)。
